1. Who these terms are between

These Terms of Service apply to every contract for Hostcraft between Hostcraft, a sole proprietorship in Switzerland (“Hostcraft”, “we”), and the business or organisation that orders it (the “Customer”, “you”).

Hostcraft is offered to businesses and organisations for their professional use, not to consumers. Your own terms and conditions apply only if we agree to them in writing.

2. The service

Hostcraft is a web application for staff microlearning. It turns training manuals and other material you provide into short lessons and nine types of playable activities. AI drafts the activities, you review and approve them, and your staff learn in your own learning space on any phone or computer browser. The features included in your subscription are those described in your quote or order.

3. Quotes and orders

The first month of a company subscription is free. We send you a written quote or order for your team, which states the scope of the subscription, the price, the billing period (monthly or yearly) and the start date. The contract is concluded when you accept the quote or order in writing (email is enough) or pay the first invoice.

4. Subscription term and automatic renewal

A subscription runs for the billing period stated in your quote or order. It renews automatically for the same period unless you or we cancel it with 90 days’ notice (see section 7).

5. Prices

The prices are those in your written quote or order, in the currency stated there. Any taxes that apply by law are shown on the quote and invoice.

We may change prices for future billing periods. We tell you by email at least 30 days before the change takes effect at your next renewal. If you don’t agree, you can cancel for that renewal, even with less than 90 days’ notice.

6. Billing and payment

Subscriptions are billed in advance at the start of each billing period. Payments are processed by Stripe, by card or by invoice. Card payments are charged automatically at each renewal; invoices are payable by the due date shown on them. Card statements show HOSTCRAFT.CH.

If a payment fails or an invoice is overdue, we remind you first. If the amount is still unpaid after the reminder, we may suspend access until it is paid.

7. Cancellation

A company subscription can be cancelled by email to info@hostcraft.ch with at least 90 days’ notice. The cancellation takes effect at the end of the first billing period that ends at least 90 days after your notice reaches us. You keep access until then, and you won’t be charged after it. We can cancel on the same terms.

A subscription for an individual or a family, billed monthly by card, can be cancelled at any time on the Billing page of the family space or by email. It ends at the end of the current month, and you keep access until then.

Either party may terminate the contract with immediate effect for good cause, for example a serious breach of these terms that isn’t remedied after a written warning.

8. Refunds

Paid billing periods are not refunded in part, except where the law requires it or for duplicate charges and billing errors. The details are in our Refund and cancellation policy.

9. Your content and AI drafts

You keep all rights to the material you upload and the content you create in Hostcraft. You grant us the right to store, process and display it only as far as needed to provide the service to you.

AI-generated activities are drafts. They can contain mistakes. Nothing is published to your learners until a person on your side approves it. You are responsible for reviewing and approving content, for the content you publish, and for having the rights to the material you upload.

10. Your users

You decide who is invited to your learning space. You are responsible for your users’ use of Hostcraft, for keeping sign-in details confidential, and for having a lawful basis for the personal data of your staff that you enter or have them enter.

11. Acceptable use

You and your users must not:

  • upload or publish unlawful content, or content that infringes the rights of others;
  • try to access other customers’ data, test or bypass our security, or disrupt the service;
  • use the service to send spam or malware;
  • resell or sublicense the service without our written agreement.

If we have good reason to believe these rules are being broken, we may remove the content concerned or suspend access, and we tell you why.

12. Availability and changes to the service

We work to keep Hostcraft available and secure, but we don’t guarantee uninterrupted availability unless we have agreed a service level with you in writing. We may carry out maintenance and improve or change features, provided the core of the service you ordered stays available.

13. Data protection

We handle personal data as described in our Privacy policy. Where we process your staff’s personal data on your behalf, we do so as your processor and only on your instructions. We will sign a data processing agreement with you on request.

14. Liability

We are liable without limitation for damage we cause intentionally or through gross negligence, and as required by mandatory law. To the extent permitted by Swiss law, we are not liable for slight negligence, indirect or consequential damage, lost profit or lost data. In any case, our total liability per contract year is limited to the fees you paid for the 12 months before the event that caused the damage.

15. Changes to these terms

We may update these terms. We tell you about changes by email at least 30 days before they take effect. They apply from your next renewal. If you don’t agree, you can cancel before then.

16. Governing law and place of jurisdiction

These terms and every contract under them are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts at the operator’s registered seat have exclusive jurisdiction, unless mandatory law says otherwise.

17. Language

These terms are available in English and German. Both versions are equivalent.
